CHAPTER 7
Chapter 7 Bankruptcy gets its name from the United States Bankruptcy Code in which the 7th chapter of the bankruptcy laws describes the most recognizable and common type of bankruptcy. When most people think about bankruptcy, they are usually thinking about chapter 7. Some people describe chapter 7 as a “liquidation,” or a “complete” or “full” bankruptcy, or the bankruptcy that “wipes everything out.”
CHAPTER 13
Chapter 13 bankruptcy gets its name from the United States Bankruptcy Code in which the 13th chapter of the bankruptcy laws describes the second most common, but less recognizable type of bankruptcy. Chapter 13 is a bankruptcy that is referred to as a “restructuring” or “modification” of your debts through a monthly repayment plan.

Prior to law school, he worked at the international securities firms of EdwardJones and A.G. Edwards responsible for external financial reporting to the SEC, stock and commodity exchanges and shareholders, and has prepared tax returns at a St. Louis CPA firm. Upon graduation from law school, he started his own law practice focusing on estate planning and divorce law, and has administered dozens of mediations. For over 20 years Mr. Benson has assisted thousands of clients file for bankruptcy relief.
